The city of Rome once again is taking the owner of the factory complex at 200 Railroad St. to court.
Corporation Council Tim Benedict said the city plans to file paperwork in state Supreme Court next week seeking the ability to enforce a 2007 court order requiring the Brooklyn-based Railroad Property Development Corp. to fix up the deteriorating site.
That order required six buildings to be demolished, he said. Those buildings remain standing today.
Mayor Joseph Fusco made it a priority to get the 13-acre complex remediated and redeveloped when he came into office in January 2012. The administration spoke with Stephanie Eisenberg, the development company?s owner, last March and she indicated she would work with the city to achieve that, Benedict said.
?As of today?s date, nothing of any substance has been presented,? he said.
The 2007 court decision was appealed by Eisenberg, but in March 2009 an appeals court gave the city the permission it needed to remediate the site, according to O-D archives. This followed years of attempts by the city to have Eisenberg correct code violations at the former Revere Copper and Brass facility after posting the property unsafe and unfit in December 2003.
The decision gave the city the right to remediate the site itself, but Benedict said that would cost hundreds of thousands of dollars ?that quite frankly we don?t have.?
The Common Council has earmarked $85,000 for the purpose of beginning the remediation process. In court, the city will seek permission to enter the property in order to investigate ?asbestos and other code and remediation issues,? Benedict said.
Eisenberg could not be reached for comment Friday.
Local law would allow the city to bill the property owner?s taxes for all costs associated with the remediation work. If the property owner doesn?t comply, the city can foreclose on the property, Benedict said.
But Mayor Fusco said he?s not giving up on working with Eisenberg to bring the buildings up to code.
?There?s a lot of square footage, and she wants to get more of it rented out,? he said. ?If she can get somebody to commit to being a tenant (at one of the empty buildings), she?ll have the money to fix that part of the (complex).?
